The parties have filed a joint petition for compromise supported by an affidavit stated, inter alia, that the entire cheque amount was paid to the complainant by the petitioner and the petitioner does not have any grievance against the opposite party.
In view of such circumstances, the parties have prayed for quashing of the order of conviction and sentence passed by the Learned Judicial Magistrate, 2 nd Court at Balurghat in C.R. Case No. 285/2017 and affirmed by the Learned Additional Sessions Judge, Special Court, Dakshin Dinajpur at Balurghat.
In view of the compromise arrived at by both the parties and taking into account the provision of Section 143 of the Negotiable Instrument Act, the instant petition for compromise is allowed. Judgement and order of conviction and sentence dated 8th October, 2021 passed by the Learned Additional Sessions Judge, Special Court, Dakshin Dinajpur at Balurghat affirming the judgment and order of conviction and sentence dated 29th May, 2019 passed by the Learned Judicial
Magistrate, 2nd Court, Balurghat in C.R. Case No. 285/2017 be quashed.
The instant revision is, accordingly, disposed of.
