The petitioner has filed the Affidavit of Service along with the postal receipt and track report showing due service upon Mr. Dhiraj Sanbui, opposite party.
None appears for the opposite party. The learned lawyer for the petitioner prays for extension of ad interim order of stay granted by the vacation bench on 30.12.2021.
Perused the record and materials therein and from where it is seen, while granting order of stay of operation of ejectment execution, the learned Appellate Court directed Judgment debtor to make payment of occupational charges @ 2,000/- (Rupees two thousand) only per month. The challans filed by the petitioner show that the petitioner is not regularly in depositing occupational charges and has been depositing at his own convenience and has failed to deposit occupational charges since the month of September, 2021 till date.
Keeping in view such facts the prayer for extension of the interim order will be considered on
payment of entire occupational charges up to December, 2021.
