This is an application seeking condonation of delay of 754

days in filing the appeal.

Learned counsel for the appellant submits that a copy of

the judgment was sent to District Magistrate and Secretary DLSA

and the learned Trial Judge had also directed the advocate for the

Legal Aid to move the higher forum against the judgment but no

steps were taken and no family member of the appellant had

come forward for filing the appeal.

Having regard to the facts disclose in the application and

considering the submission of the learned counsel for the

appellant, we are of the opinion that the delay in filing the appeal

has properly been explained.

Delay in filing the appeal is condoned.

Accordingly, CRAN 1 of 2021 is allowed.

The appeal is admitted.

Let the original records be requisitioned.

The department is directed to prepare the paper books.
