This is an application for review of a
judgment and order dated 10th June, 2021
passed by a Division Bench of this court, where
one of us (Aniruddha Roy, J.) was a member.
Review of a judgment and order can be made on
very limited grounds as provided in order 47 rule
1 of the Civil Procedure Code. It is available if
there is an error apparent on the face of the
record or on the basis of discovery of evidence
which in spite of due diligence could not be
found or made available when the order was
passed.
In this application for review there is
absence of those grounds.
The grounds sought to be made out in this
application relate to the alleged errors in the
findings reached by the learned bench. This
ground if found tenable may be entertained in
another forum but certainly not in the exercise of
its review jurisdiction.
For all of those reasons, the application for
review is not entertained and is dismissed.
The application CAN 1 of 2021 is
accordingly, disposed of.
