                 By an order dated 8th July, 2021 passed in

           W.P.A. No. 5959 of 2021, the petitioner was allowed

           pension in terms of the order of the respondent stated

7th April, 2016 and also paid with arrears.

The petitioner is receiving pension and has also

received all arrears of pension. The petitioner now

seeks payment of interest on the delayed payment of

pension.

Counsel for the petitioner, Mr. Manna, relies

upon a series of judgments of the Hon'ble Supreme

Court of India in this regard.

Counsel for the respondent denies that the

petitioner is entitled to any arrears or that there is any

delay in paying pension.

This Court is of the view that the matter cannot

be decided without exchange of affidavits.

Let affidavit-in-opposition to the main writ

petition be filed within a period of three weeks from

date. Reply, if any, thereto be filed two weeks

thereafter.

Liberty is granted to mention the matter after

completion of pleadings.

All parties are directed to act on a server copy of

this order duly downloaded from the official website of

this Court.
