appearing for the petitioner, while assailing the

judgment dated 20th June, 2022 passed by Waqf

Tribunal, West Bengal in Original Application No. 17 of

2019, submits that the resolution dated 26.09.2018

duly affirmed on 15th November, 2018 has been

inappropriately affirmed without truly adverting to the

facts and circumstances presented and pressed upon

dismissing the original application on contest.

The issue raised in this case needs to be

addressed upon securing presence of the opposite

parties.

Petitioner is directed to serve the copy of

application upon the opposite parties and their learned

advocate appearing in the Court below, by speed post

with A/D, and furnish affidavit of service on the next

returnable date.

The affirmation of the resolution dated 26 th

September, 2018 duly followed by confirmation on 15th

November, 2018 will abide by the final decision of this

case.

List the matter in the second week of February,

2023.
