An order of conviction passed by the trial Court
and affirmed by the First Court of Appeal for the offence
punishable under Sections 384/511 of the Indian Penal
Code is assailed in the instant revision.
I have considered the documents being the
evidence adduced by the witnesses on behalf of the
prosecution, specially the evidence of P.W.6 and P.W.11
and limiting myself to the bounce of revisional
jurisdiction I am prima facie of the view that the
impugned judgment of conviction and sentence and the
Appellate order affirming the same are required to be
scrutinized under the scope of revisional jurisdiction.
Accordingly, the instant revision is admitted.
The petitioner is directed to serve notice upon the
private opposite party No.2 under registered speed post
with A/D and file affidavit of service within three weeks
from the date of this order. The State of West Bengal be
served through the learned Public Prosecutor, High
Court, Calcutta.
Operation of the order of sentence passed against
the petitioner be stayed for a period of six weeks.
