Mr. Monojit Basu, Adv.
... for the appellant in person
Mr. Debashish Roy, Adv.
Ms. Sumitra Das, Adv.
Ms. Riya Chatterjee, Adv.
...for the respondent
The petitioner is unable to produce the copy of SLP claimed
to have been filed by him before the Hon'ble Supreme Court. The
petitioner is appearing in person. He has submitted that due to
non-availability of CAN 3 of 2021 and CAN 4 of 2022, he could
not file additional documents along with Special Leave Petition.
We are unable to accept the submission of the petitioner
because the copies of the said applications are with the petitioner
and on the last occasion he argued on the merits of the said two
applications. The grounds for adjournment appeared to be
frivolous and flimsy. The purpose is to avoid the payment, which
he is supposed to pay in terms of our order to his minor son.
We direct the petitioner to produce the copy of SLP, which
he claimed to have been filed before the Hon'ble Supreme Court,
by way of an affidavit by 3rd August, 2022.
In the event the petitioner is unable to produce the copy of
the said SLP and disclose his bank details and file an affidavit in
terms of the judgment of the Hon'ble Supreme Court in Rajnesh
vs. Neha, reported in 2021(2) SCC 314, we shall pass appropriate
orders securing the payment which the petitioner is required to
pay to his minor child in terms of the order dated August 1, 2011.
The aforesaid direction is peremptory.
Let the matter be listed on 3rd August, 2022.
