The Court: Heard the parties.
It is submitted on behalf of the decree-holder that notwithstanding an earlier
order of Court the bank guarantee for a sum of Rs.6.5 crores furnished by the
judgment-debtor nos.2 and 3 has lapsed. Mr. Medora appears on behalf of the
judgment-debtor nos.2 and 3 and submits that he needs to take instructions insofar as
the submissions of the decree-holder are concerned.
In the meantime, Mr. Medora is directed to take instructions. If the bank
guarantee for Rs.6.5 crores, in terms of an earlier order of Court has lapsed, the
judgment-debtor nos.2 and 3 shall furnish fresh bank guarantee in compliance with the
earlier orders of Court.
Mr. Ghosh appears on behalf of the judgment-debtor nos.1 and 4 and submits
that the bank guarantee for Rs.5.5 crores furnished by his clients is continuing and
subsisting.
