Realization of fine amount from the present

appellant be suspended till disposal of the instant

appeal.

The interim bail which was granted by the learned

trial Judge on 1st October, 2021 be confirmed till the

disposal of the appeal on the same terms and

conditions.

It appears from the impugned judgment passed in

Sessions Case No.323/2014 corresponding to Sessions

Trial No.59(11) of 2014 that in all 20 (twenty) accused

persons faced trial for committing offence under

Section 323/324/326/302 of the Indian Penal Code.

Out of the said 20 (twenty) accused persons, the

accused Nikhil Singha, Asim Singha and Goutam

Singha were sentenced to suffer life imprisonment and

to pay fine of Rs.50,000/- (Rupees Fifty Thousand)

each for committing offence under Section 302 /34 of

the Indian Penal Code, in default, to suffer further

rigorous imprisonment for 5 (five) months each.

Against the judgment and order of conviction and

sentence the above named accused persons filed CRA

No.316 of 2021 which is pending before the Division

Bench having determination.

Since the instant appeal arises out of the same

judgment, the same is required to be heard with CRA

316 of 2021. Therefore, the instant appeal is released

with a direction to list the same with CRA 316 of 2021

before the Division Bench having determination.
