Defect was reported. Inter alia, there is order dated 30 th

September, 2008 made by coordinate Bench in order sheet.

It says as follows:-

"None appears when the matter is called on. The learned advocate for the appellant is directed to file original certified copy of the judgment and decree of the trial Court by three weeks after the re-opening of this Court after long vacation for the year, 2008. In default, the appeal shall stand dismissed."

The contingency of default happened long ago.

The appeal is dismissed.
