The instant criminal revision was heard in full. The case was reserved for delivery of judgment. In the mean time this Court came across as a judgment delivered by a Single Bench of the Madras High Court in CRLOP No. 28458 of 2019(Dr. P.Padmanathan and Ors. -vs- TMT> V.Monica delivered on 18th January, 2021.
On going through the judgment this Court is of the view that the finding made in the said judgment has got some relevance and persuasive value in the instant matter.
However, this Court feels that without giving an opportunity to both the parties it will be unfair for the Court to consider the said judgment and to pass final order in the instant revision. Therefore, this Court like to hear on the question of law and submission of the learned counsels for the parties on the abovementioned judgment. Therefore, this Court refrains from delivering final judgment in the instant revision at this stage.
The matter be fixed for hearing on 19 th February, 2021 as " Part Heard".
