The certified copy of the judgment, which is produced
along with the appeal memorandum, does not show that the
accused person was sentenced though he was convicted.
However, learned Counsel for the appellant has shown us the
photocopy of a free copy given to the accused at the time of
handing down the sentence. We see from that material that the
accused was sentenced. He is now stated to be housed in a
Correctional Home suffering the sentence.
We direct the Court of the Additional Sessions Judge, 5 th
Court, Howrah, to forthwith issue to the accused person in
Sessions' Trial Case No. 233 of 2017 a free certified copy of the
judgment delivered in that case on 18.06.2019. Such copy
shall be transmitted to this Court within two days from the date
of receipt of a copy of this order and the Department shall
incorporate that certified copy in this appeal.
Department is directed to communicate this order to the
learned Court below for necessary compliance.
Appeal is admitted.
Issue usual notices.
Call for the lower court records.
Realization of fine, if any, shall remain stayed.
Liberty to pray for bail upon notice to the State.
