1) This Application was taken up for final hearing on 11 th

December, 2023. At that time, learned counsel for the Applicant made a

statement that, the Respondent No.1 has been duly served with the Rule

notice. However, when the matter was taken up for dictating the judgment,

it was noticed that, the Rule notice has not been served upon the

Respondent No.1. Hence, subject to payment of cost of Rs.10,000/-, to be

paid by the Applicant, an opportunity is granted to the Applicant to serve the

Rule notice upon the Respondent No.1 and to argue the Application afresh.

The cost of Rs.10,000/- shall be paid within a period of two

weeks from the date of uploading of this Order to the Advocates' Association

of Western India Generation Next Fund bearing Account Number

2)               The Rule notice is made returnable on 16th February, 2024.

3)               Learned Advocate for the Applicant is directed to comply with

the service of the Rule notice upon the Respondent No.1 within a period of

two weeks from the date of payment of cost, failing which the Application

shall stand dismissed without further reference to the Court.

3.1) List the Application on 16th February, 2024 under the caption

'for compliance'.
