1. When the matter is called out, this Court is informed by Mr. Zain

Mookhi, learned counsel for the Plaintiff that the proposal of the

Defendants to settle the matter is not acceptable to the Plaintiff and as a

counter-offer his client proposes to receive the entire amount rather than

the goods.

2. Mr. Vishal Raman, learned counsel for the Defendants No.1, 2 and

4 would submit that since the Defendant No.1 is a company, this counter-

offer would need to be placed before the Board of the said company and

some time be granted for the same. Both the learned counsel submit that

the matter be listed on 29th January, 2024.
