2. This is an application seeking to quash First Information Report in Crime No.252/2018 registered with Police Station Sadar, District Nagpur for the offence punishable under Sections 13(1)(c), 13(1)(d), 13(2) of the Prevention of Corruption Act.

3. The learned Counsel for the applicant has stated that the applicant is exonerated in departmental enquiry for the same allegations.

4. Learned Counsel for the applicant has relied on the judgment of Ashoo Surendranath Tewari Vs. CBI reported in (2020) 9 SCC 636 to contend that in said offences the applicant has been discharged on exonerating in departmental enquiry.

5. Issue notice to the non-applicants, returnable after six weeks.

6. Learned A.P.P. waives service of notice for non- applicant/State.

7. Stand over to 02.09.2024 for final disposal.
