1. Heard learned counsel for the appellant.

2. The suit for partition and possession filed by the present

appellant was decreed by the learned trial Court and it was declared

that the plaintiff had 1/9th share in the suit land. However, the first

appellate Court reversed the judgment and decree of the trial Court

and dismissed the suit. In the fact situation, the various legal

questions may arise for consideration.

3. Hence, issue notice to the respondents before admission,

returnable on 03.11.2023.
