Heard learned Counsel for the petitioner.

2. It is submitted that instead of deciding the issue nos.5 and 6 regarding conduct of the inquiry being fair and proper and the findings not being perverse as a preliminary issue (pg 40), the impugned judgment decides all the issues together which has resulted in violation of the law laid down by the Hon'ble Apex Court in Shankar Chakravarti vs Britannia Biscuit Company Limited, (1979 DGLS (SC) 276) (para 27).

3. Issue notice for final disposal to the respondents, returnable in two weeks.

4. Till the returnable date, there shall be interim stay in terms of prayer clause (ii) of the petition.
