petitioner, though the election petition was well within limitation in view of the direction issued by the Hon'ble Supreme Court in Miscellaneous Application No. 21 of 2022 and other connected matters, however, by way of abundant precaution, the application for condonation of delay was filed. It is stated that the learned District Judge erroneously rejected the said application by the order impunged.
4. I have heard the learned counsel for the petitioner, the learned counsel for the contesting respondent and the learned AGP for the respondent- State.
5. The limitation for filing election petition as per Section 21 of the Maharashtra Municipal Councils, Nagar Panchayats and Industrial Townships Act, 1965 is ten days from the date of publication of names of the councillors in the Official Gazette.
6. In the present matter following facts are not in dispute:
"(i) 19 January 2022- Date of declaration of result,
(ii) 28 January 2022- Publication of the names of councillors in Official Gazette and
(iii) 9 March 2022- Filing of the election petition."

In the event the actual balance period of limitation remaining, with effect from 01.03.2022 is greater than 90 days, that longer period shall apply. IV.
