seeks time to respond to the arguments canvassed by learned

counsel for the petitioner viz. issue being covered by the

judgment of the Division Bench of this Court delivered on

22/10/2019 in WP/2367/2019.

counsel for the petitioner are, in view of the aforesaid Division

Bench judgment of this Court since the materials which are

discovered during the recording of calls and messages were

directed to be destroyed, there is hardly any justifying material to

continue the prosecution against the petitioners.

3. We expect learned counsel for respondent no. 1 to seek

instructions as to the status of Special Leave Petition, if any,

preferred against the aforesaid Division Bench judgment of this

Court.

4. Let the response be placed including affidavit-in-reply by

03/03/2023.

5. Matter to come up for consideration on 08/03/2023.
