"The Counsels state that by mistake it was pointed out to the Court that the sanction was given by the Principal Commissioner of Income Tax, hence covered by the judgment of this Court in Siemens Financial Services Pvt. Ltd. v. Deputy Commissioner of Income Tax & Ors. 1, whereas the sanction has been given by the Principal Chief Commissioner of Income Tax as per the document at Exhibit-R1 annexed to the affidavit-in-reply filed through one S. S. Prasad, Income Tax Officer affirmed on 10th August 2023.

In view thereof, the order dated 30 th October 2023 is recalled."

3. Petition be listed for admission on 9th January 2024.
