1. Leave to amend to add the first informant as a

party respondent No.2 without disclosing her identity.

Amendment to be carried out within a period of one week

from today.

2. After the amendment is carried out, issue notice

to respondent No.2, returnable on 19.10.2022. In addition,

the Investigating Officer shall inform the respondent No.2

about pendency of the Appeal, this Application and the next

date of listing and shall make a statement to that effect

before the Court on the next occasion.

3. This is an application for bail pending appeal.

The applicant was convicted by the Extra Joint Special Judge

under POCSO Act, Greater Mumbai vide his judgment and

order dated 13.6.2022 passed in POCSO Special Case

No.72/2017. The applicant was convicted for commission of

offence punishable under Section 7 read with 8 of POCSO

Act and under Section 354 of IPC. The major punishment

imposed on him was for three years and fine of Rs.3,000/-.

4. The applicant was on bail during trial and even

after his conviction bail under Section 389(3) of Cr.P.C.

Therefore, till the next date the bail granted by trial court

post his conviction is continued.

5. Stand over to 19.10.2022.
