IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CIVIL APPELLATE JURISDICTION
WRIT PETITION NO. 7726 OF 2021
Sanjay Kumar } Petitioner
Versus
Union of India and Ors. } Respondents
Mr. Rahul Walia for the petitioner.
Ms. Anjali Neel Helekar with Mr. P. J. Khosla for the
respondents (UoI).
CORAM: DIPANKAR DATTA, CJ. &
MADHAV J. JAMDAR, J.
DATE: SEPTEMBER 21, 2022 P.C.: 1. Prima facie, we are satisfied that the Central Administrative Tribunal (hereafter "Tribunal", for short) pronounced its judgment on 8th October 2021 without
granting opportunity to the parties to know the tenor of clarifications that each of them provided in terms of the order dated 18th August 2021.
2. Also, it appears that the Tribunal had earlier reserved judgment on 3 (three) occasions, i.e., 11th November 2020, 15th February 2021 and 12th March 2021. The long delay in delivery of judgment, according to Mr. Walia, learned advocate for the petitioner, could have caused a failure of justice.
3. We are, in the aforesaid circumstances, inclined to order a remand of the original application for fresh hearing by the

Tribunal; hence, we have requested Ms. Helekar, learned advocate for the respondents to obtain appropriate instructions.
4. List the writ petition on 28th September 2022 'for directions'.
