ORAL JUDGMENT : (PER : SUNIL B. SHUKRE, J)

1] Heard. Rule. Rule made returnable forthwith. Heard

finally by consent of the learned counsel for the parties.

2] It is seen from the reply that jail authorities now have

agreed to release the petitioner, on furlough, on modified terms

and conditions. The modified terms and conditions are that the

petitioner shall furnish bond of Rs.50,000/-, surety bond of

Rs.100/- regarding surrender on due date and personal bond of

Rs.50,000/- and also cash deposit Rs.1,00,000/-.

3] We are of the view that calling upon the petitioner to

make cash deposit of Rs.1,00,000/- would be too harsh a condition

and therefore, we quash and set aside this condition, while other

conditions like furnishing of surety bond of Rs.50,000/-, whether

relative or non relative, surety bond of Rs.100/- regarding

surrender on due date and personal bond of Rs.50,000/- are

confirmed.

The writ petition is allowed.

Rule is made absolute in the above terms. No costs.
