1. The State has filed appeal against judgment and order of acquittal of the respondent of the offence punishable under Section 306 of the Indian Penal Code. The respondent was convicted under Section 498-A of the Indian Penal Code and sentenced to suffer rigorous imprisonment for two years and six months.
2. Considering the sentence the respondent could have been released on bail by invoking the powers under Section 389 of the Code of Criminal Procedure by learned Additional Sessions Judge, Nagpur.
3. Despite service the respondent has not appeared before this Court.
4. Issue bailable warrant against the accused/respondent in a sum of Rs.5,000/- (Rs. Five Thousand Only) returnable within three weeks.
