2 Learned Counsel for the appellant submits that notice was duly

served on the respondent but she refused to acknowledge the same.

Learned Counsel also invited my attention to the said remark of refusal

annexed along with the affidavit-of-service.

3 In view of above, there shall be stay to the impugned judgment

and order dated 22/09/2021 passed by the Extra Joint District Judge,

Niphad in Regular Civil Appeal No. 91 of 2018.

                   4      Issue notice to   respondent, returnable on 24th February, 2022.
