Shri Patil, learned counsel for the appellant, upon instructions, states that the judgment of the Reference Court is covered by the policy of the Vidarbha Irrigation Development Corporation, in which, in the matter of construction, if there is an enhancement up to 25%, no appeal is to be preferred, in view of which, he seeks to withdraw the appeal.

The statement is accepted. First Appeal is dismissed as withdrawn. No order as to costs.
