1 The learned A.G.P. accepts notice for Respondent no.1. The

learned Counsel appears for Respondent no.3 to 7 and submits that

Respondent nos.3 to 7 are supporting the Petitioner. The learned

Counsel appears for the Respondent no.2 and seeks time to take

instruction.

2 The grievance of the Petitioner is that the impugned Circular is

issued without notice to the Petitioner. The Petitioner has been

granted NOC for SRA scheme. Under the impugned Circular, same is

determined. According to the learned counsel, as per section 13(2)

of the Maharashtra Slum Areas (Improvement, Clearance And

Redevelopment) Act, 1971, the same should not have been done

without issuing notice to the Petitioner. The learned counsel also

relies upon the judgment of the Division Bench of this court in case

of Lokhandwala Infrastructure Pvt.Ltd. And another v. State of

Maharashtra and others1 .

3 As time is sought on behalf of Respondent no.2, place the

matter on 14.09.2022. Till next date, no further steps be taken by

Respondent no.2 with regard to the writ/scheme to be implemented

by the Petitioner.
