been served. Statement is accepted. None present for the respondents
when the matter was called out. No Affidavit-in-Reply has been filed by
the respondents. Learned Counsel for the petitioner to serve fresh notice
to respondent No.2. Private notice is permitted by all permissible modes of
service available in law. It shall be made clear that if respondent No.2 does
not remain present on the next date, the matter would be finally heard
and would be proceeded ex-parte against respondent No.2.
2. The other matters which are kept on board are clubbed with this
petition for hearing and final disposal on the same day at the same time.
3. Parties are at liberty to file brief proposition of law and furnish
copies of the Judgments which they propose to rely upon in support of
rival contentions in advance with the copies to be served upon other side.
