Learned counsels for the parties fairly agreed that since the impugned judgment is dated 28.09.2017, the interests of the parties would be served if the appellate order is maintained and the suit is directed to be expedited. In my considered opinion, this is a fair submission in view of the fact, that the impugned Judgment is in force since last more than four years.
2. Accepting the above position, the petition is dismissed.
3. The trial Court, however, is directed to decide R.C.S. No. 51/2017, as expeditiously as possible and in any case within a period of one and a half years from today.
4. The petition is accordingly disposed of.
