1. We have heard the learned advocate for the applicant and the learned prosecutor. We have also perused paragraph Nos. 23 and 24 of the judgment delivered by the learned Full Bench dated 25-01-2021 in Criminal Application No. 2073 of 2020 in Criminal Writ Petition No. 1362 of 2020 (The State of Maharashtra Versus Guddu @ Kansha Wahab Shaikh).
2. Issue notice to the respondents, returnable on 07-06-2021. The learned prosecutor waives service of notice on behalf of the respondent.
3. On the next date, we would consider the submissions of the learned advocate for the applicant in the backdrop of the view expressed by the learned Full Bench in paragraph Nos. 23 and 24 of the judgment dated 25-01-2021 and we would first decide at the threshold, whether to receive the proceedings or not.
