Hearing was conducted through Video Conferencing and the learned counsels agreed that the audio and visual quality was proper.

2. This application has been made for condonation of 10 days delay caused for filing appeal against the judgment and order dated 7th December, 2020 passed by the Family Court, Akola. The appellant and her advocate are absent. Learned Advocate for the respondent submits that against the same judgment and order dated 7 th December, 2020 respondent has also filed an appeal which is registered as Family Court Appeal No.24/2020. The issue involved in both the appeals are identical. Learned Advocate for the respondent in all fairness submits that this Court may condone the delay by

taking a liberal view.

3. We have gone through the application. The reasons in support of prayer for condonation of delay are probable and acceptable. Accordingly, we condone the delay of 10 days.

4. We make it clear that if the petitioner and her Advocate do not appear on next date, the matter would be finally heard in their absence. FAMILY COURT APPEAL STAMP No.2331 OF 2021 .

This Family Court Appeal be registered and shall be tagged with Family Court Appeal No.24/2020.
