1. Learned counsel for the applicant seeks his release on bail on account of illness of his three years' old daughter, who is diagnosed with blood cancer. Learned APP placed reliance on the judgment of this Court wherein it is observed that while releasing the applicant on temporary or interim bail in serious offences like MCOCA, the parameters and restraints imposed by the enactment must also be satisfed.
Learned APP is permitted to argue the same, but he should also ascertain the medical condition of the child of the applicant, by making special reference to the medical papers placed on record.
