1. This matter is placed before this Court in view of report of the

learned Judge, C.R.No.10, Court of Small Causes, Mumbai seeking

extension of six months time for disposal of T.E. & R. Suit No. 23/23

of 2003. The said report is dated 8 th December 2020. However, Mr.

Rajendra Thakkar, the learned counsel for the petitioners states that

the trial in T.E. and R. Suit No.23/23/2003 is completed, the

arguments of both the parties are also over and the matter is now

kept for judgment.

2. Mr. Thakkar further states that, however, in the meanwhile,

Writ Petition (St.) No. 2349 of 2021 (Smt. Ramaben Laljibhai Kapadia

Since deceased) through her L.Rs. Jagdish Laljibhai Kapadia & Ors.

Vs. Forbes & Company & Ors.) is filed by the present respondents, as

the written arguments and 94 authorities filed by the respondents

after conclusion of the arguments were not taken on record.

3. The office is, therefore, directed to list this Writ Petition and

the report of the learned Judge, Court No. 10, Court of Small Causes,

Mumbai along with Writ Petition (Stamp) No. 2349 of 2021.
