ORAL JUDGMENT :

1. Heard.

2. The petitioner is aggrieved by the interlocutory order dated 21 st

August, 1998 passed by the Industrial Court on applications below Exhibits U-2

and U-52, U-2 and U-18 and U-2 and U-16 in Complaint (ULP) Nos. 197 of

1998, 216 of 1998 and 226 of 1998 respectively.

3. The substantive prayer put forth in the prayer clause (D) of the

petition reads as under:-

"(D) Pending the hearing and final disposal of the present writ petition, grant stay to the implementation, execution and operation of the judgment and order passed by the Member, Industrial Court, Ahmednagar below Exhibits U-2 and U-52 in Complaint (ULP) No.197/98, below Exhibits U-2 and U-18 in Complaint (ULP) No.216/1998 and below Exhibit U-2 and U-16 in Complaint (ULP) No. 226/1998 dated 21st of August, 1998."

4. This Court, by order dated 10th November, 1998, after hearing the

litigating sides, had granted interim relief in terms of prayer clause (D) and thus

stayed the interlocutory order.

5. I have heard the learned Counsel for the respective sides for quite

sometime. It is undisputed that the interim order of this Court continues to

operate for the last about 19 years.

6. Considering the above, this petition is disposed of with a direction to

the Industrial Court, Ahmednagar to decide the Complaints (ULP) No. 197 of

1998, 216 of 1998 and 226 of 1998 on their own merits, if not already

decided/disposed of, as expeditiously as possible and preferably on or before

29th December, 2017. Needless to state, the objections with regard to the

maintainability of the complaints would also be gone into by the Industrial

Court while deciding the complaints finally.

7. The interim relief granted by this Court by order dated 10 th

November, 1998 shall continue till the complaints are decided and shall merge

in the final judgment of the Industrial Court. Rule is discharged.
