ORAL JUDGMENT
1] Rule, made returnable forthwith. Heard finally by
consent of the learned counsels appearing for the parties.
2] All these petitions are preferred challenging the
decision of the State Government in revision given on 14.06.2016
by the State Minister of the Department of Co-operation who has
set aside the order dated 08.08.2013 passed by the District Deputy
Registrar, Co-operative Societies, Nagpur granting the petitioners
deemed membership of the federation i.e. Nagpur District Labour
Co-operative Society Federation Limited, Nagpur.

3] It is observed by the Minister in the order that the
federal society has issued letter dated 14.09.2012 asking all the
petitioners to remove certain deficiencies in their applications for
membership. The same were not removed and hence, the District
Deputy Registrar committed an error in granting them deemed
membership under Section 22(2) of the Maharashtra Co-operative
Societies Act, 1960.

Undisputedly, there was an application for
condonation of delay caused in filing revision before the State
Government under Section 154 of the Maharashtra Co-operative
Societies Act. The ground raised in the petition specifically
pertains to non-disposal of the application for condonation of
delay and proceeding to decide the appeal on its own merits
without passing an order condoning the delay. These facts have
not been disputed by any of the respondents. It is, therefore,
apparent that the Minister concerned should not have proceeded
to decide the matter on its own merits without first deciding an
application for condonation of delay. Be that as it may, there is no
application of mind to the contention raised by the parties on
merits of the claim. In the revisional jurisdiction the authority has
to record specific finding as to the nature of deficiencies, whether

the removal of deficiencies were mandatory and non-compliance
of it, if any, should result in rejection of the application for
conferment of deemed membership. In the absence of all such
findings on relevant aspects, the order passed by the Minister
cannot be sustained. The same will have to be set aside with an
order of remand.
5] In the result, writ petitions are allowed. The order
dated 14.06.2016 passed by the State Minister of the Co-operation
Department in revision is hereby quashed and set aside.
The matters are remitted back for decision afresh keeping in view
the observations made by this Court. Initial decision has to be on
the application for condonation of delay and subsequent decision
has to be after application of mind to the rival contentions raised
by the parties concerned. The parties to appear before the
revisional authority on 09.01.2017. The revisional authority to
decide the revision within a period of four months thereafter.
No fresh notices shall be issued to the parties concerned.
The parties to file their pleadings or affidavits on the first date of
appearance before the State Government.

6] Rule is made absolute in above terms. No order as to
