Learned counsel for first respondent and the
learned counsel for second appellant present through virtual mode. It was represented by the learned counsel for second appellant that the first respondent herein filed E.P.No.17 of 2023 before the Principal Senior Civil Judge's Court, Srikakulam for execution of the proceedings. In the execution proceedings, the delivery warrant was also ordered. If the property is delivered, the purpose of filing of the second appeal will be defeated.
Considering the aforesaid submissions made by the learned counsel for second appellant, the execution of decree is stayed for a period of four (4) weeks.

For the reasons mentioned in the accompanying affidavit filed in support of the application, the delay of 23 days in filing the second appeal against the judgment and decree in A.S.No.95 of 2019, dated 06.05.2022 on the file of I Additional District Judge, Srikakulam is condoned.
Accordingly, this petition is ordered.
