1. Today when the matter is taken up for hearing, it was

represented by the learned counsel for the appellant that though

they have made several efforts to contact the party, but the party is

not responding properly and there are no instructions from the

party.

appellant is recorded.

4. Therefore, the Appeal Suit is dismissed for default. There

shall be no order as to costs.
