Senior Counsel for the appellants, who made his
submissions inter alia that the Judgment and
Decree of the Trial Court in creating charge in
respect of the plaint schedule property under
Section 100 of the Transfer of Property Act until
realization of the decretal amount is beyond the
scope of the relief sought for in the suit.
He also submits that the respondents 1 & 2
/ plaintiffs also preferred an appeal vide A.S.No.392 of 2024.
Issue notice to the respondents. Learned counsel for the appellants is permitted to take out personal notice to the respondents by RPAD and file proof of service by the date of next adjournment.
Considering the submissions made, there shall be stay of all further proceedings as prayed for.
List this case along with A.S.No.392 of 2024, after four (4) weeks.
