The Court made the following:

ORDER:

The Writ Petition is filed under Article 226 of the Constitution of India,

seeking the following relief:

".....to declare the action of the 2nd respondent, constructing a building to establish the office of the 3rd respondent on the land to an extent of 2280 Sq. yards in Block No.36, Hanumanpet, Vijayawada (Old survey No.974 to

978, Arandalpet) now in R.S.No.1003/1 and R.S.No.1003/2 of revenue Block No.33 is belongs to petitioner which was purchased by her grandfather vide document No.271/1922, whereas the land alienated and allotted to the 3rd respondent by the state government as per G.O.Ms.No.13 dated 25.01.2016 is in R.S.No.1009 as per revenue map of Block No.33, Ward No.8 of Bezwada town as illegal, arbitrary, unconstitutional and in violation of fundamental rights, consequently direct the 2nd respondent not to take any further construction on the land to an extent 2280 Sq. yards in Block No.36, Hanumanpet, Vijayawada (Old survey No.974 to 978, Arandalpet) in R.S.No.1003/1 and 1003/2 of Block No.33, Ward No.8 of Bezwada town and to hand over the same to the petitioner, and pass such other order or orders....."

2. Heard Mr.Krupachand Gogineni, learned counsel for the petitioner,

learned Assistant Government Pleader for Medical, Health and Family

Welfare, appearing for the respondents 1 and 3, learned Assistant

Government Pleader for Revenue, appearing for the respondents 4, 5 and 7

and Mr.Ch.Venkata Reddy, learned Standing Counsel for APMSIDC,

appearing for the 2nd respondent.

3. Though the petitioner made several allegations against the

respondents, during hearing, learned counsel for the petitioner limited his

request to dispose of the representation dated 15.06.2024 submitted by the

petitioner, without touching the merits of the case.

4. On the other hand, learned Assistant Government Pleader for Medical,

Health and Family Welfare, appearing for the respondents 1 and 3, readily

agreed to dispose of the said representation submitted by the petitioner, if

any, pending with the respondent-authorities.

5. In view of the submission of the learned Assistant Government Pleader

for Medical, Health and Family Welfare, I need not decide the truth or

otherwise of the allegations made in the petition. This Court is conscious that

no such direction be issued, in view of the Judgment of the Honourable Apex

Court in "The Government of India v. P.Venkatesh 1 ", wherein the

Honourable Apex Court held that such orders may make for a quick or easy

disposal of cases in overburdened adjudicatory institutions. But, they do no

service to the cause of justice. Hence, I find no other alternative except to

issue such direction.

6. In the result, the Writ Petition is disposed of, directing the

1st respondent to dispose of the representation dated 15.06.2024 submitted by

the petitioner as expeditiously as possible, preferably within a period of four

(04) months from the date of receipt of a copy of this order. There shall be no

order as to costs.

7. As a sequel, miscellaneous applications pending, if any, shall stand

closed.
