Note 07 18.11.2024 RRR, J & MRK,J
Learned Senior Counsel appearing for the appellant assails the action of the Waqf Board as well as the Judgment of the Learned Single Judge on the ground that the notification, under the Waqf Board Act, 1954 declaring the subject property as a Waqf property, has not been preceded by an inquiry or survey, as required under the provisions of the Waqf Act, 1954.
Learned Standing Counsel appearing for the Waqf Board states that such a survey has been completed and seeks time to place the survey report before this Court by the next date of hearing.
Learned Standing Counsel is also relying upon the report said to have been given by the Inspector of Waqf on 20.11.2014. The report filed along with the papers is incomplete as page No.2 of the said report is missing and he seeks time for producing this report also.
