JUDGMENT:

- (per Hon'ble Sri Justice Ravi Nath Tilhari)

The appellant filed O.P.No.980 of 2005 in the Court of the District Judge,

East Godavari, Rajahmundry, under Order 33 Rule 1 of CPC for permission to

file the suit as indigent person. The said application was dismissed on

04.12.2006. Challenging the same, the present CMA was filed.

2. Sri B.Sudhakar Kumar, learned counsel appears for the appellant and

submits that the appellant has died. Consequently, the appeal is rendered

infructuous.

3. Sri Venkat Challa, learned counsel representing Sri S.V.Maruti Sankar,

learned counsel for the respondents has no objection.

4. The Civil Miscellaneous Appeal is dismissed as infructuous.
