The Court made the following:

JUDGMENT:

1. When the matter was listed on the earlier occasions i.e., on 22.04.2024,

29.04.2024 and 26.06.2024, there was no representation on both sides and

the same was posted today, under the caption 'For Dismissal'.

2. Today when the matter is taken up for hearing, learned counsel

representing on behalf of the respondents is alone present. Though the matter is listed under the caption 'For Dismissal', there is no representation on behalf

of the appellants. It seems that the appellants are not inclined to prosecute the

appeal.

3. Therefore, the Appeal Suit is dismissed for non-prosecution. There shall

be no order as to costs.

As a sequel, miscellaneous petitions, if any pending, shall stand

closed.
