The Court made the following Order:

The present Civil Revision Petition is filed against the order dated

28.09.2018 in I.A.NO.1087 of 2018 in A.S.No.201 of 2012 passed by the

learned XII Additional District Judge, Vijayawada.

02. The impugned order is refusing to defer the hearing of appeal on tthe

ground that the stay granted by the High Court was deemed to have been

vacated in view of the Judgment of the Hon'ble Supreme Court in Asian Resurfacing of Road Agency Private Limited and another vs. Central

Bureau of Investigation reported ins (2018) 16 SCC 299.

03. It is the contention of the petitioner that the approach of the trial

Court is erroneous as stay was granted in Transfer C.M.P.No.750 of 2015

dated 19.04.2016 and that the same was pending as on the date of the

impugned order.

04. Be that as it may. It is now brought to the notice of this Court that the

Transfer C.M.P.No.750 of 2015 was allowed by this Court on 15.12.2020

and A.S.No.201 of 2013 from the II Additional District Judge, Krishna at

Vijayawada was transferred to be heard along with S.A.No.14 of 2015,

pending before this Court. In view of the same no further orders are

required to be passed.

Hence, the Civil Revision Petition is dismissed as infructuous. No

order as to costs.

As a sequel, the miscellaneous petitions if any shall stand

dismissed.
