                SECOND APPEAL No.498 of 2009

JUDGMENT:

Both the learned counsel present. Learned counsel for the

appellant reported that they filed a Memo dated 08-09-2023 vide

U.S.R.No.91074 of 2023 stating that the matter was compromised

between the parties out of the Court and they seek permission to

withdraw this Second Appeal.

Permission is granted.

Accordingly, this Second Appeal is dismissed as withdrawn.

No costs.

As a sequel, miscellaneous petitions, if any pending, shall

stand closed.
