ORDER:

Aggrieved by the order dated 08.07.2015 passed in

I.A.No.1218 of 2015 in O.S.No.243 of 2012 on the file of

Principal Junior Civil Judge, Kurnool, the petitioner has filed

the present C.R.P.

2. When the matter came up for admission on 25.08.2015,

this Court granted interim stay as prayed for and notice was

ordered to the respondent. Thereafter, the matter was listed on

30.10.2015 and adjourned by one week.

3. Sri Jagadeesh, learned counsel representing Sri

T.Narasimhulu, learned counsel for the petitioner is present

and none appeared for respondent.

4. Today when the matter is taken up for hearing and on

perusal of the record, it is found that the Registry has put up a

copy of the Judgment and Decree dated 31.08.2018 passed in

O.S.No.243 of 2012 by the II Additional Junior Civil Judge,

Kurnool, wherein the petitioner herein/defendant was directed

to pay a sum of Rs.62,370/- to the respondent herein/plaintiff

with subsequent interest @12% per annum from the date of the

suit till the date of decree and thereafter @6% per annum till

the date of realization on principal amount of Rs.30,000/-

along with costs Rs.5,919/-.

4. In view of the above, this Court finds that cause of action

does not survive in this matter and accordingly the C.R.P. is

closed.

There shall be no order as to costs.

As a sequel, miscellaneous petitions pending, if any, shall

stand closed.
