I have heard learned counsel
Ms.S.V.Bhuvaneswari, represented on behalf
of Mr.S.V.Muni Reddy, learned counsel for
the petitioner.
The learned counsel Mr.Ganesh,
represented on behalf of Mr.G.Kondala Rao,
learned counsel for Respondent Nos.16 and
17 who are legal representatives of deceased Respondent No.1/plaintiff.
The learned counsel representing Respondent Nos.16 and 17 would submit that they have no objection for allowing the petition.
This petition is filed by the petitioner under Section 5 of Limitation Act, to condone the delay of 260 days in presenting the Second Appeal against the Decree and Judgment in A.S.No.47 of 2008 on the file of V-Additional District Judge, Rayachoty dated 22-12-2018.
For the reasons stated in the affidavit of the petitioner, to give an opportunity to the petitioner to proceed with appeal, this petition is allowed.
The delay of 260 days in presenting the appeal is hereby condoned.
