Heard Sri N.Naveen Kumar, learned counsel for
the petitioners/appellants/defendants.
Learned counsel would submit that the Trial Court
committed error on the premise that the appellants
published false information, though the alleged
information was based on some other news item and
further, the amount awarded by the learned Trial Court
towards damages is not based on any reasons, and
therefore, the Decree of the Trial Court may be stayed till
disposal of the appeal under Order XLI Rule 5 of the
Code of Civil Procedure, 1908.
Considering the facts and circumstances
submitted by the learned counsel for the petitioners/
appellants/defendants and the affidavit filed for the
petitioners, there shall be 'Interim Stay' of the Decree
and Judgment dated 05.07.2023 passed in O.S.No.121
of 2011 on the file of II Additional District Judge, Sl. OFFICE ORDER No. DATE NOTE Visakhapatnam, for a period of eight (08) weeks subject
