                   APPEAL SUIT No.548 of 2008

JUDGMENT:

Learned counsel for the respondent is present.

2. On 04.11.2023, there was no representation on behalf of

the appellant and the same was adjourned to 08.11.2023. On

that occasion also, i.e., on 08.11.2023, there was no

representation on behalf of the appellant. Therefore, the matter

was adjourned to today i.e., on 09.11.2023 under the caption 'for

dismissal'.

3. Even though, the matter was listed today under the caption

'for dismissal', there is no representation on behalf of the

appellant.

4. Hence, this Appeal is dismissed for non-prosecution. There

shall be no order as to costs.

As a sequel, miscellaneous petitions, if any pending, shall

stand closed.
