Criminal Revision Case Nos.2787 & 2797 of 2018

COMMON JUDGMENT:

Subject matter in both the revision cases pertains to CC No.313 of 2016 on

the file of the III Additional Judicial Magistrate of First Class, Tirupati (presently,

Principal Junior Civil Judge's Court, Tirupati).

2. Accused No.1 in CC No.313 of 2016 filed Crl.M.P.No.4522 of 2016,

whereas, Accused No.2 filed Crl.M.P.No.4523 of 2016, under Section 239 Cr.P.C.,

before the trial Court seeking discharge. By way of separate orders, both the

applications were dismissed by the trial Court vide order dated 03.07.2018.

Aggrieved by the same, Accused No.1 filed Crl.R.C.No.2787 of 2018, whereas

Accused No.2 filed Crl.R.C.No.2797 of 2018.

3. Though both the revision cases filed in the year 2018, this Court has not

passed any interim order. In the meanwhile, the trial Court framed charges against

the accused in CC No.313 of 2016.

4. Today, when both the matters came up for hearing, it is represented by

both the counsel that the trial in CC No.313 of 2016 has already been commenced

and witnesses were also given summons.

5. In view of the above facts and circumstances, with the consent of both

the counsel, without going into the merits of the cases at this belated stage, as the

trial has already commenced, this Court is inclined to close both the revision cases by dispensing with the presence of the accused before the trial Court, except on

the dates, where their presence is necessary.

6. Accordingly, both the criminal revision cases are closed, dispensing with

the presence of Accused Nos.1 and 2 in CC No.313 of 2016 before the trial Court,

except on the dates, where their presence is necessary.

7. Miscellaneous petitions, if any pending, in these two revision cases, shall

stand closed.
